Terms and Conditions of Use
Raffle Lottery Tickets and 50-50 Draw Tickets
Any purchase made through the Darelle Media Inc. website for raffle lottery tickets or 50-50 draw tickets go directly to licensee less an agreed to administrative fee.
A transaction fee is charged by Stripe Inc for processing your purchase and is subject to the terms and conditions set out between Stripe Inc as the payment processor and the licensee as the organization running the raffle.
darelle.com is a cause driven social e-commerce platform that brings Buyers and Sellers together to negotiate transactions based on the terms and conditions they themselves agree to, (the "Services") through our website and other online areas owned or operated by us, such as our Facebook page, Twitter page, YouTube or any other social media page (the "Site"). The Services also include the opportunity for you to create or join Buy Requests created by others or create or purchase existing Offers on Main Street or Raffle Tickets (Buy Requests and Main street Offers Described Below) for the products and services of third party Merchants. The Services and Site are collectively referred to here as "darelle.com", or “darelle”.
Conditional Use of Our Site and Services
Your permission to use darelle.com is conditioned upon your agreement that you:
are 13 years of age or older, but are 18 years of age or older to purchase anything on darelle.com, create a Buy Request or make an Offer;
will comply with these terms of service (“Terms of Service”);
will not copy or distribute any part of darelle.com in any medium without darelle's prior written authorization;
will provide accurate information when creating an account or registering for our Services;
are solely responsible for your User ID or profile and the activity that occurs while signed in to or while using darelle.com using your User ID;
will not use darelle.com to collect any personally identifiable information, including account names, email addresses, or other such information, for commercial purposes;
will not use the communication systems provided by or contacts made on darelle.com for any commercial solicitation purposes, other than those outlined by darelle.com;
are solely responsible for your content submissions (“Content”), including discussion posts, profile Information, Buy Requests created, Offers made and links, pictures, and other such Content;
represent that you own or have the necessary licenses, rights, permissions, and consents to use and authorize darelle.com to use any and all Content submitted by you to darelle.com in accordance with the licenses granted in this Agreement;
hereby grant each darelle.com user (“User”), whether using darelle.com or an application authorized by darelle.com, but developed via a third-party developer, a non-exclusive license to access the Content you submit through darelle.com and to use, reproduce, distribute, prepare derivative works of, display and perform such Content as permitted through darelle.com's functionality and under these Terms of Service;
will not harvest or otherwise collect information about Users, including email addresses, without their consent
will not submit Content that is copyrighted or subject to third party proprietary rights, including privacy, publicity, trade secret, etc., unless you are the owner of such rights or have the appropriate permission from their rightful owner to specifically submit such Content to darelle.com; and hereby affirm we have the right to determine whether any of your Content submissions are appropriate and comply with these Terms of Service, remove any and/or all of your submissions, and terminate your account with or without prior notice.
Your Account and darelle.com Profile
You will need to register by creating an account with darelle.com in order to publish Content on the Site or obtain access to certain Services. If you choose to create an account or darelle.com profile with us, you agree to provide only accurate, complete registration information, and you will keep that information up-to-date if it changes. When you register, you will create a unique login, a "User ID" that you yourself create and this is how you will be known throughout the experience and your time on darelle.com. Access to the darelle.com Site and Services is not authorized by any other person or entity using your User ID and you are responsible for preventing such unauthorized use. Individuals and entities whose privilege to access the Site or use the Services has previously been terminated by darelle.com may not register for an account, nor may you designate any of those individuals to use your account on your behalf.
darelle.com relies on a User’s User ID to know whether Users accessing the Site and using our Services are authorized to do so. If someone accesses our Site or Services using a User ID that you created, we will rely on that User ID and will assume that access has been made by you. You are solely responsible for any and all access to the Site or use of the Services by persons using your User ID. Please notify us immediately if you become aware that your User ID is being used without authorization.
Non-Confidentiality, Security and Privacy
You understand that much of the information that you submit to us, such as Offers created, Posting, Organizational information or User profiles and Buy Requests are submitted precisely for the purpose of disclosure in a variety of ways by darelle.com, and therefore such information is not subject to any confidentiality obligation. Other information, such as credit card information provided in connection with the purchase, is maintained with appropriate privacy and security protections. You agree that the information provided to us in connection with the purchase of an item on darelle.com other than your credit card information may be disclosed by us to the Merchant or Business partner or partners, if needed to execute a transaction.
Any communications between you and darelle.com, such as email or other correspondence, in which you offer suggestions or comments for improving or modifying our Services will be deemed by us to be non-confidential and non-proprietary, and you agree that such information may be used by us without any limitation whatsoever.
Rules Regarding Information and other Content
When you use the Site, you can publish and obtain access to various kinds of information and materials, all of which we call "Content." Content also includes information and materials posted to the Site by you. You agree not to revise or obscure Content posted by others, and you agree not to post or use any Content in any manner that:
violates the privacy, publicity, or other rights of third parties,
is false or inaccurate, or
is unlawful, defamatory, discriminatory, libelous, pornographic, obscene, abusive, threatening, harassing, pornographic, hateful, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate, as determined by darelle.com in its sole discretion,
infringes the copyright, trademark, trade secret, or other intellectual property or proprietary right of others,
could damage our company, any User, affiliates, advertisers, or other parties.
Although we strive to enforce these rules with all of our Users, and despite our best efforts, you may be exposed through the Site or Services to Content that violates our policies or is otherwise offensive. Use the Site and Services at your own risk and know that we may, but are not obligated to terminate User accounts and/or remove Content from the Site we determine or suspect violate the terms of this Agreement. We take no responsibility for your exposure to Content on the Site whether it violates our content policies or not.
General Rules of User Conduct
darelle.com aims to make the use of our Site and Services a good experience for all of our Users. As such all Users consent and agree not to do any of the following:
conduct or promote any illegal activities while using the Site or Services;
upload, distribute or print anything that may be harmful to minors;
attempt to reverse engineer or jeopardize the correct functioning of the Site or Services, or otherwise attempt to derive the source code of the software (including the tools, methods, processes, and infrastructure) that enables or underlies the Site;
use the Site or Services to generate unsolicited email advertisements or spam;
upload or transmit any form of virus, worm, Trojan horse, or other malicious code;
attempt to gain access to secured portions of the Site or Services to which you do not possess access rights;
use any automatic or manual process to search or harvest information from the Site or Services, or to interfere in any way with the proper functioning of the Site and Services; or impersonate another User.
Links to Third Party Sites
darelle.com does not have control over the actions or behaviors of other websites that darelle.com may link to. darelle.com may contain links to third party websites that are not owned, operated, or controlled by darelle.com. Therefore, we cannot and do not assume responsibility for the Content, privacy policies, or practices of such websites or the companies that own them. Further, we cannot and will not attempt to censor or edit the Content of any third party Site. By using darelle.com you expressly relieve us from any and all liability arising from your use of any third party website.
Fees and Services
Joining darelle.com and creating Buy Requests, making Offers on Buy Requests or posting certain items or Offers for sale on Main Street is generally free, unless it is a Raffle or 50/50 draw. We may charge fees for services, such as listing certain types of items or making Offers on Buy Request, however not always. Fees are normally charged for acting as agent for sale of the voucher and or listing fee when a transaction is actually completed through redemption or in certain instances when an Offer on a Buy Request is made. Changes to that policy are effective after we provide you notice by posting the changes on the darelle.com site or delivering corresponding electronic communication of said change. We may choose to temporarily change the fees for our services for new services or scenarios, and such changes are effective when we post them or effectively communicate said changes. Unless otherwise stated, all fees are quoted in Canadian Dollars. You are responsible for paying all fees and applicable taxes associated with our sites and services in a timely manner with a valid payment method. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms, including charging other payment methods on file with us, retaining collection agencies and legal counsel, and for accounts over 180 days past due, requesting deductions of the amount owed from your Stripe Inc account balance.
How It All Comes Together
darelle.com provides Users with opportunities to create Buy Requests for the product and services they are interested in. Those Buy Requests are available to be searched for by other Users to join, thereby increasing demand or in some cases sent to (third party “Merchants” or “Businesses”) who have created profiles that match the Buy Request. Merchants may then create Offers for the products and services they would like to Offer for sale that often carry with them a time limited promotional added value that is inherent in each Offer (an "Offer"). Many Merchants are willing to Offer attractive promotions, terms and conditions in order to reach the reach the darelle.com community and satisfy the demand inherently created through the creation of a Buy Request and satisfied through Offers made available to Users. Once you have found an Offer that you would like to purchase, you do so by placing order on an Offer. Further, by doing so you are agreeing to purchase the Offer you have selected according to the terms, restrictions and conditions associated with that Offer. Once an order is placed you will receive a confirmation of the details of the Offer and your payment will be processed via Stripe for the amount of the Offer. We will notify you by email when the Voucher, which is defined below, for the Offer is ready to be used. An account is required in order to place an order and subsequently purchase any Offer, Make an Offer or create a Buy Request. It is a requirement so that we can collect the necessary information required to allow you to pay for your Offer and provide you with access to print the Vouchers that correspond to Offers purchased or sold, redeem said Vouchers view your past purchases or sales, and or modify your preferences.
darelle.com provides consumers with opportunities to create Buy Requests for products and services they are interested in and makes them searchable by third party Merchants or Businesses and or notifies them according to the terms of their profile settings. Buy Requests are further searchable and able to be shared by any other User of darelle.com to get other Users to join the Buy Request and increase demand. This demand often entices third party Merchants and Businesses to provide attractive Offers (See Offers described Below) that are often closely related to the initial Buy Request. It is important to note that a Buy Request itself cannot dictate the terms of an eventual purchase and is used by third party Merchants and Businesses as a guide to help decide what Offer to make and on what terms and conditions. It is always the terms and conditions laid out in the Offer that comprise the terms and conditions of sale. A Buy Request itself cannot be purchased and is not in and of itself a commitment to purchase, but rather is meant to act as an indication of intent or an expression of interest created to generate an Offer from a business. The Offers generated by Merchants or Businesses in response to a Buy Request created or joined are sent to you to review and you make the decision to purchase the Offer at that time or simply take no action whatsoever and wait for additional Offers. As more Buy Requests and Offers become available on darelle.com, additional terms and conditions may be added to this Agreement. It is your sole responsibility to check the Site from time to time to view any such changes in the Agreement. If you do not agree to any changes, if and when such changes may be made to the Agreement, you must cease use of the Site and Services.
darelle.com provides consumers with opportunities to purchase products and services from third party Merchants and Businesses ("Businesses") at a preferred rate ( “Offers"). Merchants and Businesses are often willing to make attractive offers when enough consumers agree to purchase the same product at one time or request an Offer by joining a Buy Request. Offers can be made in response to a specific Buy Request, in which case they are attached to the Buy Request for easy review by those who have joined the Buy Request or the Merchant or Business can simply create an Offer and post it on Main Street making it searchable and available to any User. The terms and conditions of any Offer are a combination of the terms and conditions outlined herein and the specific terms and conditions outlined by the Merchant or Business offering the product or service in the Offer itself. As Main Street Offers become available on darelle.com, additional terms and conditions may be added to this Agreement. It is your sole responsibility to check the Site from time to time to view any such changes in the Agreement. If you do not agree to any changes, if and when such changes may be made to the Agreement, you must cease use of the Site and Services.
The expiration date for a Voucher is as printed on the Voucher.
The expiration or draw date for a raffle or raffle ticket is outlined at the time of purchase. Specific details are covered in the price description or in the Rules of Play for the specific raffle. If the expiration of the paid value of the Voucher for a normal Main Street Deal, in accordance with the date printed on the Voucher, is prohibited under the law of the jurisdiction in which the Merchant or Business is located, then the Voucher shall expire as follows: the promotional portion of the Voucher will expire on the date printed on the Voucher, and the paid portion of the Voucher will expire five (5) years from the date the Voucher is issued, except to the extent applicable law requires that the Merchant or Business extend the period in which the Voucher may be redeemed. The Merchant or Business is obligated to honor the Voucher in compliance with law. If the Merchant or Business refuses to honor the Voucher before the relevant expiration date, then darelle.com will refund the paid portion of your Voucher in the form of a Credit for Future Purchases. In order to receive the credit or refund in either form, you must contact us through the contact us page or email us at; firstname.lastname@example.org with: (a) identification of the Voucher and Merchant with whom you sought to redeem the Voucher, (b) statement of the date, time, and circumstances in which the Merchant refused to redeem the Voucher, and (c) a true and accurate statement that the Voucher has never been redeemed with the Merchant.
Credit for Future Purchases
"Credit for Future Purchases" (herein after referred to as “CFP” or “CFP’s”) is a form of darelle.com currency that may be applied towards future purchases on darelle.com. CFP’s expire five years after the date of issuance except where expiration is prohibited by law. CFP’s may only be applied towards purchases that are in the same currency as they were issued and are not returnable or refundable for cash, except where required by law. Resale of CFP’s is strictly prohibited.
Specific Terms of Offers
Each Offer has specific terms and conditions associated with it as outlined in the Offer itself. Review the terms and conditions of each Offer before you commit to purchasing the Offer. Offer specific terms will supersede any inconsistent terms in this Agreement, except to the extent, such terms are prohibited by applicable law. Offers made to Users and the associated terms and conditions of the Offer are determined by the Merchant or Business and agreed to by you when you purchase the Offer, except to the extent, such terms are prohibited by law.
Unless otherwise stated in the Voucher or required by law, the following additional terms will apply to all Vouchers:
no cash or surrender value for any Voucher,
no change, cash back, or credit will be issued for partial redemption of the paid portion of a Voucher, except as required by law,
no change, cash back or credit will be issued for partial redemption of the promotional portion of a Voucher,
use of a Voucher for alcoholic beverages is at the sole discretion of the Merchant or Business, which may be limited by applicable law, unless otherwise noted on the Voucher,
Vouchers cannot be combined with any other coupons or promotions unless otherwise noted on the Voucher,
Vouchers cannot be redeemed against any taxes, tips, prior balances or purchases, shipping or handling, unless otherwise noted on the Voucher,
neither darelle nor the Merchant or Business is responsible for lost or stolen Vouchers or Voucher reference numbers,
Vouchers are issued to you personally and duplicate use, sale or trade of a Voucher is strictly prohibited.
unless otherwise stated at the time a Voucher is purchased, the Voucher price does not include sales, value added or use taxes, which may be charged to you separately by the Merchant or Business at the time you redeem the Voucher.
In addition to the terms and conditions outlined above, the following terms and conditions apply to Restaurant Vouchers sold by darelle.com:
It is at the sole discretion of the Restaurant to determine whether Restaurant Vouchers can be combined with any other Restaurant certificates, third party certificates, coupons, or promotions.
The redemption frequency for Restaurant Vouchers is determined by the applicable Restaurant, and shall be contained in the Voucher offer on darelle.com
Whether the use of the Restaurant Voucher for alcoholic beverages is permitted, is determined by the applicable Restaurant, in its sole discretion. The Restaurant agrees to comply with all relevant laws pertaining to the same.
Restaurant Vouchers cannot be used for taxes, tips or prior balances, unless permitted by the Restaurant.
Restaurant Vouchers are valid for dine-in only unless otherwise stated.
The issuing of Restaurant credit is at the sole discretion of the Restaurant unless otherwise required by law.
Merchant – Business Responsibility
darelle.com provides the platform and from time to time markets the Offers created by Merchants and acts as a listing agent in selling the Vouchers on behalf of the Merchants or Businesses. However, the Merchant or Business is the issuer of the Voucher and as the issuer of the Voucher, the Merchant or Business is fully responsible for any and all loss, injuries, illnesses, damages, claims, liabilities and costs suffered by or in respect of a customer, caused in whole or in part by the Merchant or Business or its products and services, as well as for any unclaimed property liability arising from unredeemed or partially redeemed Vouchers. By purchasing an Offer, a customer acquires the right to print a Voucher issued by the participating Merchant or Business and to use the Voucher according to its terms and conditions as laid out in the Offer and subsequent Voucher and the terms of this Agreement. Whether you choose to print and/or redeem the Voucher is within your sole control and at your sole discretion.
Products, Services and Items Available For Sale
darelle.com is currently only offered to residents of Canada, However, it can still be accessed from countries and potential Users around the world. As a result, from time to time some products or services provided on the Site may not be available for purchase to persons residing in certain jurisdictions or geographic areas or may not be deliverable. In such cases and circumstances darelle.com reserves the right, in its sole discretion, to exclude or otherwise limit the provision of a Voucher for any product or service to a person residing in any jurisdiction or geographical area. darelle.com does not represent or warrant that any product or service promoted on the Site will be available for purchase by any particular person.
It is hereby agreed that darelle.com begins providing services to you in connection with Offers available to you as soon as you receive your Voucher for the relevant Offer purchased. darelle.com will provide a refund of the purchase price paid by you for any Offer within (5) five calendar days after the purchase of a Voucher, provided that the Voucher has not yet been redeemed. If it has been redeemed, your right to cancel and receive a refund immediately ceases. After (5) five calendar days, darelle.com does not provide refunds except in the case that you are unable to redeem a Voucher before the applicable expiration of the Voucher because the relevant Merchant or Seller has gone out of business.
Refunds for Ticketed or Dated Events
Vouchers for ticketed or dated events are always non-refundable.
General Rules to Keep the Playing Field Level
Some of the Offers are provided for a limited number of Buyers or a limited number of purchases, as specified for the particular Offer. Any attempt by a Buyer to obtain more than the permitted number of Vouchers specified for a particular Offer by using multiple or different identities, credit cards, forms, registrations, addresses or any other method will void that person's purchases. darelle.com will determine, in our sole discretion, whether purchase characteristics indicate a violation of these rules and take the necessary steps.
We may change or discontinue the Site or any of the Services at any time without prior notice. We reserve the right to terminate this Agreement at our election and for any reason, without prior notice, and this Agreement will automatically terminate in the event that you violate any of the terms and conditions set forth below. In the event of any termination, you will immediately cease access to the Site and Services.
Disclaimers of Warranty
We provide the Site and Services "as is", "with all faults" and "as available." We and our suppliers and affiliates make no express warranties or guarantees about the Site, or Services.
Limitations of Liability
YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISPUTE WITH US IS TO DISCONTINUE YOUR USE of darelle.com.
You agree to defend, indemnify and hold harmless darelle.com, its parent company, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to reasonable attorney's fees) arising from: (i) your use of and access to darelle.com; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that any Content submitted by you causes damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of darelle.com.
You acknowledge and agree that we and our licensors retain ownership of all intellectual property rights of any kind related to the Site and Services, including applicable copyrights, trademarks and other proprietary rights. We are not granting any license to you under any of those intellectual property rights by virtue of this Agreement, except for the limited right to use the Site and Services in accordance with this Agreement. "darelle.com" is our trademark. Other product and company names that are mentioned on the Site or provided as part of the Services may be trademarks of their respective owners. We reserve all rights that are not expressly granted to you in this Agreement.
The Content on darelle.com, excluding all intellectual property of other sites obtained by way of API and linking and Content posted by our customers, is owned by darelle.com. This includes, without limitation, the text, software, scripts, graphics, photos, sounds, interactive features and the trademarks, service marks and logos contained therein ("Marks"). The Marks are owned or licensed to darelle.com, subject to copyright and other intellectual property rights under applicable law, the law of the jurisdiction where you reside, and international conventions. Content provided by darelle.com is provided to you "AS IS" for your information and personal use only and may not be used, copied, reproduced, modified, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. We reserve all rights not expressly granted in and to the Site and Services.
As between you and us, you retain any intellectual property rights in any copyrighted materials and trademarks that are contained in Content that you post to the Site. You grant us an irrevocable, perpetual, non-exclusive, royalty-free, fully paid, worldwide license, with rights to sublicense through multiple levels of sub-licensees, to reproduce, make derivative works of, translate, distribute, publicly perform and publicly display in any form or medium, whether now known or later developed, to make, use, sell, import, offer for sale, otherwise commercially exploit and exercise any and all such rights, under any and all of your intellectual property rights related to the Content in any manner we choose. If you have any rights to the Content that cannot be licensed to us (such as moral rights in some countries), you unconditionally and irrevocably waive the enforcement of such rights, and all claims and causes of action of any kind against us or related to our customers and partners anywhere in the world, with respect to such rights.
The communications between you and darelle.com use electronic means, whether you visit the Site or send us emails, or whether darelle.com posts notices on the Site or communicates with you via email. For contractual purposes by creating an account and agreeing to the terms and conditions of use you (a) consent to receive communications from darelle.com in an electronic form; and (b) agree that all terms and conditions, agreements, notices, disclosures, and other communications that darelle.com provides to you electronically satisfy any legal requirement that such communications would satisfy if it were in writing. The foregoing does not affect your non-waive able rights.
Entire Agreement, Changes to this Agreement and Waivers
No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.
Except as explicitly stated otherwise, any notices shall be given by registered mail to Darelle Media Inc. Attn: Legal Department 885 West 60th Avenue Vancouver, V6P 2A2 B.C., Canada or e-mail address given to us during the registration process (in your case). Notice shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. Alternatively, we may give you notice by certified mail, postage prepaid and return receipt requested, to the address provided to darelle.com during the registration process. In such case, notice shall be deemed given three (3) days after the date of mailing.
Resolution of Disputes
If a dispute arises between you and darelle.com, our goal is to provide you with a neutral and cost effective means of resolving the dispute quickly. Accordingly, you and darelle.com agree that we will resolve any claim or controversy at law or equity that arises out of this Agreement or our services (a "Claim") in accordance with one of the subsections below or as we and you otherwise agree in writing. Before resorting to these alternatives, we strongly encourage you to first contact us directly to seek a resolution by going to the contact us help page. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.
Law and Forum for Disputes
This Agreement shall be governed in all respects by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. You agree that any claim or dispute you may have against darelle.com must be resolved by a court located in Vancouver, British Columbia, except as otherwise agreed by the parties. You agree to submit to the personal jurisdiction of the courts located within Vancouver, British Columbia for the purpose of litigating all such claims or disputes.
Reporting Policy Violations
If you see a listing that violates darelle.com policies, please report it by clicking the "Chat with darelle" link in the listing, or by clicking the Contact Us button located on most of our help pages and using the email address provided for communication. When a policy violation occurs, we email the seller and the bidders or the buyer to let them know that the listing has been removed from darelle.com.
Each of these policies may be changed from time to time. Changes take effect when we post them on the darelle.com site. When using particular services on our sites, you are subject to any posted policies or rules applicable to services you use through the sites, which may be posted from time to time. All such policies or rules are hereby incorporated into this Agreement.
Additional General Terms
We may amend this Agreement at any time by posting the amended terms on this site. Except as stated elsewhere, all amended terms shall automatically be effective 30 days after they are initially posted. This Agreement may not be otherwise amended except in a writing signed by you and us. This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof. The following sections survive any termination of this Agreement: Fees and Services (with respect to fees owed for our services), Release, Content License, Liability, Indemnity and Resolution of Disputes.
Rules about Buy Requests, Offers and Paying
You will no longer be able to create Buy Requests, or use darelle.com at all, if you have provided information that is untrue on your account.
Buyers and Sellers need to be able to get in touch with each other, and we need to be able to get in touch with them.
You must pay for any item you buy;
You must sell any item you Offer for sale according to the terms and conditions prescribed
Many of the items on darelle.com are sold in a process where a vendor makes an Offer to sell an item or provide a service in response to on a Buy Request. Remember that each Offer you make is a binding contract to sellthe item if the buyer agrees. Not paying for an item after you have agreed to buy it, or selling something offered for sale has some negative consequences, which may include being permanently banned from darelle.com.
You can only make Offers if you really intend to sell the item. You cannot make Offers on a Buy Request that you created. Be careful about making Offers for sale of several items if you only want to sell one.
You can only retract an Offer under very specific circumstances and must contact darelle.com directly to do so if one unit of a multiple unit Offer has already been sold.
For example, if you offered 100 units for sale and 1 unit has already been purchased then you are unable to change any of the terms and conditions of the Offer. All 100 units must be sold according to the terms of the original Offer Please carefully go over the terms and conditions you are Offering the potential purchaser including all necessary item descriptions, shipping details and limits you may place on your Offer prior to publishing it on darelle.com.
Many of the problems Buyers and Sellers encounter start with a simple misunderstanding about what is for sale, being Offered for sale or what is being requested through a Buy Request and the terms of the eventual sale. For example, some Buyers only want to buy from businesses in a certain geographic area. If you know the potential buyer or seller you cannot manipulate the Buy Request and subsequent Offer process with the intent to artificially increase or decrease its price or desirability. This rule applies to family, friends, roommates, employees, and online connections.
You cannot make Offers on Buy Requests and may not use darelle.com to fulfill the transaction of items bought outside of darelle.com or that are not covered by our policies. Buyers and Sellers have to follow the same rules, and if a seller Offers to sell you something outside of darelle.com do not accept the Offer.
Be honest and have good intentions when you participate in (or initiate) any resolution.
Attempts to manipulate these processes are prohibited and can have serious consequences.
You cannot interfere with another Buy Request or Make Offer process.
In other words, you cannot contact other potential Buyers to "warn" them about a seller. If you are concerned about a seller's behavior, you can report it to us and we will investigate.
There are rules that all darelle.com members, both Buyers and Sellers, need to know and follow. These rules are created to protect you and to keep darelle.com a safe place to buy, sell, and participate in the Community.
YOU AND DARELLE.COM AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO DARELLE.COM MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
You represent that you are legally able to accept these Terms of Service. You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in this Agreement, and to abide by and comply with this Agreement. And as stated in the Conditional Use of Our Site and Service, above, you affirm that you are, in any case, 13 years of age or older. If you aren't, you must please cease use of darelle.com.
